  • “WhatsApp Official API” refers to messaging services provided through Meta Platforms.
  • “RCS” refers to Rich Communication Services provided through telecom operators and Google-supported platforms.
  • “Platform” means our website, dashboards, portals, or communication systems.
  • “Applicable Law” means laws of India including IT Act 2000 and related rules.

3. Acceptance of Terms

By registering, accessing, or using our services, you confirm that:

  • You have read and understood these Terms.
  • You agree to comply with all applicable Indian laws.
  • You agree to comply with Meta Business Policy and RCS messaging policies.

If you do not agree, you must discontinue use immediately.

4. Description of Services

NAVNATH JAGTAP provides digital messaging and communication facilitation services including:

  • WhatsApp Official Business API integration
  • RCS-based business messaging
  • Customer communication automation
  • Notification and transactional messaging
  • Promotional and marketing communication solutions

We act as a facilitator and technical integrator and do not own WhatsApp or RCS networks.

5. Eligibility

You must:

  • Be at least 18 years of age.
  • Be legally capable of entering into a binding contract.
  • Use services only for lawful business purposes.
  • Not be barred under Indian law from receiving services.

6. Account Registration

To access certain services, you may be required to:

  • Provide accurate business information.
  • Submit KYC documents where required.
  • Maintain confidentiality of login credentials.
  • Notify us immediately of unauthorized access.

NAVNATH JAGTAP reserves the right to suspend accounts providing false or misleading information.

7. User Responsibilities

You agree:

  • Not to send spam or unsolicited bulk messages.
  • To obtain proper customer consent before messaging.
  • Not to send unlawful, abusive, misleading, or prohibited content.
  • To comply with TRAI regulations and Meta messaging policies.
  • To use approved message templates for WhatsApp.

Violation may result in immediate suspension without refund.

8. Payment & Billing Terms

  • All services are chargeable unless otherwise stated.
  • Payments must be made in advance unless agreed otherwise.
  • Fees are non-refundable unless required by law.
  • Taxes (GST) shall be applicable as per Indian tax laws.
  • Failure to pay may result in suspension.

9. Subscription Renewal & Termination

  • Subscriptions renew as per agreed plan.
  • Either party may terminate with written notice.
  • We may terminate immediately for policy violations.
  • Outstanding dues remain payable post-termination.

10. Use of WhatsApp Official API & RCS

Users must comply with:

  • Meta Business Messaging Policy
  • WhatsApp Commerce Policy
  • Google RCS Business Messaging Guidelines
  • TRAI telecom regulations

NAVNATH JAGTAP is not responsible for suspension of WhatsApp numbers by Meta due to policy violations by Users.

11. Message Delivery & Compliance Policy

Message delivery depends on:

  • Telecom operator availability
  • End-user device connectivity
  • Platform restrictions

We do not guarantee 100% delivery.

Users are solely responsible for message content compliance.

12. Intellectual Property Rights

All software, dashboards, trademarks, branding, and proprietary systems of NAVNATH JAGTAP remain our exclusive property.

Users may not:

  • Copy or reverse engineer systems.
  • Use branding without permission.
  • Resell services without authorization.

13. Confidentiality

Both parties agree to maintain confidentiality of:

  • Business data
  • Customer data
  • Pricing and agreements
  • Technical documentation

This obligation survives termination.

14. Disclaimer of Warranties

Services are provided “as is” and “as available”.

We do not warrant:

  • Uninterrupted service
  • Error-free operation
  • Compatibility with all systems
  • Guaranteed platform approvals

15. Limitation of Liability

To the maximum extent permitted under Indian law:

  • NAVNATH JAGTAP shall not be liable for indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid by the User in the preceding 3 months.

16. Indemnification

You agree to indemnify NAVNATH JAGTAP against:

  • Claims arising from unlawful messaging.
  • Policy violations.
  • Intellectual property infringement.
  • Regulatory penalties caused by your actions.

17. Governing Law (India)

These Terms shall be governed by the laws of India.

Courts located in Pune, Maharashtra shall have exclusive jurisdiction.

18. Changes to Terms

We may update these Terms at any time.

Updated Terms will be posted on our website and become effective immediately upon publication.
